Terms & Conditions

A shared understanding, from our home to yours.
Here is what to know about shopping with KASHMIRCART,
our responsibilities, and your rights.

Read the terms

WE DON'T JUST SELL KASHMIRI PRODUCTS, WE FARM THEM.

Introduction & acceptance

Welcome to KASHMIRCART. These Terms & Conditions explain the basis on which you may use www.kashmircart.in and purchase products through it. KASHMIRCART is a multi-category brand offering Kashmiri products and other goods, with family roots dating to 1977 and an online journey beginning in 2016.

Please read these terms, the relevant product information and the linked policies before registering or placing an order. You can return to this page or print it for your records. Acceptance must arise from an informed action in the relevant account or purchase process, where the applicable terms are made available to you.

Simply visiting or browsing this website does not create a purchase contract. Account use and purchases may involve acceptance of the terms relevant to that activity. Order acceptance is addressed in Section 7.

Your rights come first.

Nothing in these terms or a linked policy removes a right or remedy that applicable Indian law protects. If a policy condition conflicts with a mandatory legal protection, that protection prevails.

Eligibility & your responsibilities

To place an order in your own name, you must be legally competent to contract under applicable Indian law. Ordinarily, this means being at least 18, capable of understanding the transaction and not legally disqualified from contracting.

A minor may browse with a parent or lawful guardian. Any purchase for a minor should be made by an eligible adult in that adult's own name and responsibility; parental involvement does not make a minor's own agreement automatically enforceable.

  • Provide accurate account, billing, delivery and contact information, and promptly report an error.
  • Use only payment methods and personal information you are authorised to use.
  • Keep account credentials confidential and use the website lawfully, without fraud or interference.
  • If ordering for an organisation, have the authority to act on its behalf.

User accounts & registration

For account access, visit My Account and use the registration, sign-in or password-recovery options made available there. If an option you need is unavailable, contact support. These terms do not require you to create an account where guest checkout is offered.

Where you create an account, keep its information accurate, choose a strong, unique password and sign out on shared devices. Do not knowingly permit unauthorised use. If you suspect access you did not authorise, change your password through an available recovery option and contact support. If recovery is unavailable or fails, ask support for assistance without disclosing your password.

Account restrictions must have a legitimate basis and are subject to Section 19. Merely holding an account does not make you automatically liable for every unauthorised transaction.

Products & product information

Read the particular product's description, specifications, net quantity, ingredients, warnings and available variations before ordering. Select the correct pack, weight or other option; a price shown for one variation does not necessarily apply to another. Availability can change as stock is sold.

Agricultural produce may naturally vary in size, colour, texture or flavour. Handmade goods, where offered, may have small craft variations. Lighting and screens can also affect photographs. These limitations do not excuse materially misleading descriptions, incorrect quantities, unsafe goods or products that fail to match their stated characteristics.

Origin, cultivation, organic status, testing and certification claims must be assessed for the individual product. Our brand statement is not a representation that every product in this multi-category catalogue is grown on our own farms, originates in Kashmir or holds the same certification.

Applicable packaging, labelling, food-safety and packaged-commodity requirements continue to apply. If essential information is missing or inconsistent, ask for clarification before purchasing; discovering an issue later does not remove your legal remedies.

Pricing, taxes & charges

Prices are displayed in Indian Rupees (INR). Check the price for your selected variation and quantity, together with the order total at checkout. Applicable taxes, shipping and any other payable charge must be disclosed before you commit to the purchase; these terms do not introduce a separate fee.

Prices may change for future purchases. A later price change does not by itself change the agreed price of an accepted order. Tax treatment depends on the product, transaction and applicable law; no single tax rate applies to the entire catalogue by virtue of these terms. The appropriate invoice or bill of supply must be issued as required by law. Contact support if you need an invoice copy or correction.

If a material pricing error is identified, it should be explained and any proposed correction communicated. You must not be charged an increased amount without your agreement. Any cancellation or refund must have a lawful basis, taking account of whether a contract has already been formed. A pricing error is not an unrestricted right to cancel accepted orders.

If checkout conflicts with an advertised price or offer, seek clarification. A conflicting checkout display does not automatically extinguish rights arising from misleading advertising or an agreed price.

Orders & order acceptance

To request a purchase, select your products, review the cart and complete the checkout steps presented to you. Before submitting, check quantities, variations, delivery details, the final amount and the applicable terms.

A purchase contract forms when your offer to buy is accepted in accordance with applicable law. The actual checkout disclosures, the substance of the confirmation communicated to you and the parties' conduct determine acceptance. An automated message that only acknowledges receipt, or an order number alone, is not necessarily final acceptance. These terms do not postpone an acceptance that has already legally occurred.

Orders may require reasonable checks concerning payment, stock, address accuracy or suspected fraud. A genuine concern should be explained where doing so is lawful and does not compromise security. If an order's status is unclear, contact support with its order number rather than assuming a payment debit proves dispatch.

If a product cannot be supplied, the issue and available resolution must be communicated. A substitution or increased charge requires your agreement. Any amount due back for unfulfilled goods must be returned in accordance with applicable law. Suspected duplication is a reason to clarify an order, not automatically retain multiple payments.

Payment terms

Use the payment methods actually offered for your order at the live checkout. Availability can depend on the order and destination. A payment logo elsewhere on the website is not confirmation that a particular method is enabled for your transaction.

For online payments, follow the payment provider's secure checkout instructions and applicable terms. Its authentication and processing requirements do not remove KASHMIRCART's own obligations to you. Cash on Delivery is addressed separately in Section 9.

If payment fails, remains pending or is collected twice

Check your order communication and bank or payment-provider record before paying again. A pending status is not necessarily a failure. Contact support with your order number, amount, payment date and transaction reference so the discrepancy can be investigated; redact unrelated financial information.

Refunds and payment reversals are subject to applicable law and the relevant payment process. Product-related refunds should also be read with the Refund and Returns Policy. Duplicate collections, failed-payment reversals and refunds for unfulfilled orders are not restricted to product-damage claims. No universal bank-processing or settlement time is promised here.

Keep your payment credentials private.

Never send full card details, CVV, banking passwords, account passwords or OTPs by email, phone or WhatsApp. This page does not collect payment information.

Cash on Delivery

The published Shipping Policy offers Cash on Delivery (COD) on eligible orders at serviceable destinations. COD is available for your particular order only when it is offered at checkout. Do not assume availability from your PIN code or a previous order alone.

Provide a correct address and reachable contact number. The Shipping Policy explains that COD orders may be confirmed before dispatch and that the disclosed order amount is collected on delivery. Please be available to receive and pay for a legitimate order, without giving up any lawful right to cancel, refuse an incorrect delivery or report a problem.

Failed delivery and return-to-origin handling follow the Shipping Policy and applicable law. Contact support promptly if a delivery cannot be completed. These terms do not add a COD surcharge, advance-payment requirement or failed-delivery penalty.

Read the Shipping Policy's COD guidance

Shipping & delivery

The Shipping Policy explains processing, serviceability, shipping charges, estimates, tracking and delivery issues. Read it with the shipping information disclosed for your actual order. This page does not create a new delivery charge, coverage promise or dispatch deadline.

Available delivery options depend on the destination and applicable shipping arrangements. Weather, road disruption, public holidays, remote access and courier interruptions may affect estimates. An estimate is not an unconditional guarantee, but describing it as an estimate does not cancel legal remedies for delay or non-delivery.

Check the complete address, PIN code and recipient's contact number before ordering. Report an error as soon as possible; a correction may be harder once a parcel has been dispatched. If tracking is missing, stalled or shows an unexpected delivery, contact support with your order number. Our responsibility under applicable law is not transferred to a courier merely because it handles the parcel.

Cancellations, returns & refunds

Read the existing Refund and Returns Policy and the cancellation guidance in the Shipping Policy. They describe the published request process. Their conditions apply only to the extent lawful; neither those documents nor these terms override mandatory consumer rights.

Requesting cancellation

Contact support as early as possible with your order number. The Shipping Policy distinguishes orders not yet processed, orders being prepared and orders already dispatched. Whether a voluntary cancellation can be actioned depends on the actual stage; sending a request is not itself confirmation of cancellation. Lawful cancellation and refund rights remain available.

Reporting a problem with an order

If goods arrive damaged, incorrect, missing, defective, unsafe or materially different from their description, contact support promptly with the order number and a clear description. Keep the packaging and label where reasonably possible, and provide photographs or a video if available. Ask for instructions before sending goods back.

A policy condition is not a waiver of your rights.

A lack of an unboxing video, a product-specific exclusion or expiry of a voluntary policy window cannot, by itself, defeat a remedy required by law. Statutory claims must be assessed on their facts and available evidence, including for food products and walnuts. Applicable statutory limitation periods still apply.

Where a refund is legally due, it cannot be refused merely because a claim is not for transit damage. Any lawful refund must be handled without unjustified delay and under applicable requirements. These terms add no return window, restocking fee, cancellation penalty or compulsory store-credit substitution.

Coupons, discounts & promotions

Each promotion is subject to the conditions disclosed for that campaign before purchase. These may address validity, eligible products or customers, minimum spend, usage limits and whether offers can be combined. No universal coupon condition or minimum order value is created by these terms.

Check that an eligible discount is reflected before submitting an order. If a coupon does not work as advertised, contact support for clarification. A technical failure does not automatically justify withholding a benefit you have lawfully earned.

Fraudulent use, deliberately duplicated redemptions or exploitation of a checkout error may be investigated and addressed proportionately. Any adjustment must have a disclosed, lawful basis, account for genuine errors and preserve benefits already validly earned. Changes to a future campaign do not retrospectively rewrite an accepted purchase.

Product use & food safety

Read the product label, ingredients, allergen information, warnings, dates and instructions before use. Store and prepare food according to its packaging and applicable instructions. Consider individual allergies or sensitivities; do not assume an item is allergen-free because an allergen is not mentioned in a promotional description.

Use non-food products only for their stated purpose and follow any external-use or other safety warnings. If packaging is compromised or a product appears unsafe, stop using it and seek assistance. For symptoms or health concerns, obtain advice from a qualified healthcare professional.

Descriptions of traditional uses or general nutrition are not medical advice, a diagnosis or a promise to prevent, treat or cure disease. Customer care in using a product does not relieve the business of responsibility for accurate information, safe goods or applicable food-safety obligations.

Intellectual property

Brand materials, original text, photographs, graphics and other website content may be protected by intellectual-property law and belong to KASHMIRCART or their respective rights holders. No ownership of third-party trademarks, photographs or other third-party content is claimed.

You may read these terms and retain a copy for personal reference. Unauthorised commercial copying, redistribution or misleading use of brand materials is not permitted, subject always to licences, permissions and exceptions provided by law.

The KASHMIRCART trademark application is processing; these terms do not claim that registration has been granted. To report an intellectual-property concern, email yourordertkc@gmail.com with the relevant URL, the material concerned, the basis of your rights and a way to contact you. Do not send unrelated personal documents.

Website availability & technical issues

The website may be temporarily unavailable because of maintenance, updates, connectivity problems or technical faults. Reasonable care is required in operating the service, but uninterrupted access, compatibility with every browser or an entirely error-free experience is not guaranteed.

If an error interrupts checkout, first check whether an order or payment was recorded before repeating the transaction. Contact support if the position is unclear. A display error or website outage does not erase a confirmed order, a payment received, a refund due or another obligation imposed by law.

Third-party services & external links

The published policies describe payment, delivery and website-service providers involved in operating the store. Refer to the provider information presented during your transaction and to the Privacy Policy for relevant service-provider categories and personal-data handling.

When you follow an external link or use an independent service, its own terms and privacy information may apply. In particular, a WhatsApp link opens WhatsApp's service. Read the information presented there before sharing details.

KASHMIRCART does not control independent external websites. However, using a service provider or linking to its terms does not exclude our own responsibility for the order, for providers acting on our behalf, or for any non-excludable legal duty.

Privacy & personal data

The Privacy Policy explains personal information handling, including the purposes of processing, relevant service providers and how to raise a privacy request. Read it before creating an account, placing an order or sharing information with support.

Personal data must be handled in accordance with applicable law and that policy. India's Digital Personal Data Protection Act, 2023 and its rules have a phased commencement; their provisions apply according to the notifications bringing them into force. Other applicable protections, including the IT Act and SPDI Rules where in force, are not displaced merely by naming the newer framework.

Accepting purchase terms is not, by itself, consent to optional marketing or an agreement to give up privacy rights. Do not share another person's information without a lawful basis.

Prohibited activities

You must not use the website to:

  • Commit fraud, place knowingly fictitious orders or use a payment instrument without authority.
  • Impersonate another person, access an account without permission or obtain private customer information.
  • Introduce malicious code, evade security controls or interfere with website operation.
  • Exploit the checkout, coupon or account systems to obtain an unauthorised benefit.
  • Copy or use protected content unlawfully, or carry out automated extraction that unlawfully accesses data, disrupts the service or breaches applicable published access rules.

These restrictions do not prohibit lawful reviews, complaints, fair use, accessibility tools or other activity protected by law.

Suspension & termination

Access or an account may be restricted where reasonably necessary to address credible fraud, a security risk, unlawful conduct or a serious breach of these terms. Any restriction should be proportionate. Where practicable and lawful, the reason should be communicated and the customer given an opportunity to clarify or challenge it; urgent security measures may need to come first.

Contact support if you believe access has been restricted in error. A restriction does not automatically cancel accepted orders, forfeit customer money or extinguish refunds and other accrued rights. Outstanding orders and payments must still be addressed fairly and in accordance with applicable law. Data retention and deletion are addressed in the Privacy Policy.

Limitation of liability

Responsibility for loss is determined by applicable law, including the nature of the obligation, causation and the remedies available. To the extent lawfully permitted, neither party is responsible for purely speculative losses or losses too remote to be recoverable under that law. This is not a blanket exclusion of consequential loss or a limit on statutory compensation.

Nothing excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence where liability cannot be excluded, or any other non-excludable obligation. Rights concerning unsafe, defective, deficient, spurious or misdescribed goods or services, and refunds or compensation required by law, remain unaffected.

No arbitrary purchase-price cap is imposed by these terms. References to technical problems, natural variations or third-party providers must not be interpreted as removing the business's mandatory responsibilities.

Indemnity

To the extent permitted by law, a person who deliberately misuses the website unlawfully, commits fraud or knowingly infringes another party's rights may be responsible for reasonable, substantiated direct losses or third-party claims caused by that conduct. Any amount sought must be proportionate to the person's responsibility and legally recoverable.

This does not impose unlimited liability for ordinary shopping, a good-faith complaint or an innocent error. It does not cover losses caused by KASHMIRCART's own fault or another person's independent conduct. A person facing a claim must have a fair opportunity to respond, and cannot be bound to a voluntary settlement without their agreement. Mandatory consumer protections prevail.

Force majeure

An event genuinely beyond reasonable control, such as a natural disaster, severe transport disruption, government restriction or major infrastructure failure, may affect performance. Any reliance on such an event must relate to its actual effect, with reasonable steps to reduce disruption and communicate material effects on an order.

Ordinary operational failures, avoidable stock errors or routine staffing problems are not automatically force majeure. This section does not permit indefinite retention of money for unfulfilled goods or remove cancellation, refund or other rights provided by law. The appropriate resolution depends on the event, the transaction and applicable legal requirements.

Complaints & grievance redressal

For a complaint, email yourordertkc@gmail.com, call +91-7006154418 or message customer support on WhatsApp. Include the order number where relevant, a brief account of the issue, useful evidence and the resolution you seek. Keep a copy of your correspondence.

If an earlier response does not address the issue, refer to that correspondence and explain what remains unresolved. Complaints remain subject to acknowledgement and redressal periods required by applicable law. Published support hours do not extend statutory deadlines.

You may also seek assistance through the National Consumer Helpline and approach a competent consumer commission, court or other authority. Using customer support is not an agreement to waive those remedies or an obligation to exhaust an internal process before exercising a statutory right.

Governing law & jurisdiction

These terms and transactions through the website are governed by applicable laws of India, including the Indian Contract Act, 1872, the Information Technology Act, 2000 and mandatory protections under the Consumer Protection Act, 2019 and applicable Consumer Protection (E-Commerce) Rules. A dispute may be brought before the courts, consumer commissions or other authorities that have jurisdiction under applicable law.

These terms do not select an exclusive city or court, require compulsory private arbitration, or restrict a consumer's statutory ability to pursue a complaint where the law permits, including by reference to the consumer's residence or place of work. A business location stated on this page is not an exclusive-jurisdiction agreement.

Changes to these terms

Revisions are published at this existing Terms & Conditions URL. Review the terms made available for a new transaction and retain a copy if needed. Material changes affecting an ongoing relationship must be communicated where required by law or appropriate to their effect; fresh acceptance must be obtained where legally necessary.

An update does not retrospectively change a completed transaction, rewrite an already accepted order or remove accrued statutory rights. A later version applies to future dealings, subject to applicable law and any further agreement required for an ongoing relationship.

Frequently asked questions

A little clarity, before you go.

How do I accept the Terms & Conditions?

Review the terms made available during the relevant account or purchase process and take the acceptance action presented there. Simply visiting this page does not create a purchase contract or mean you have waived your consumer rights.

When is my order confirmed?

A receipt-only acknowledgement or order number is not necessarily final acceptance. Acceptance depends on the checkout disclosures, the actual confirmation and applicable law, as explained in Section 7. If the message is unclear, ask support to confirm your order's status.

Can I cancel an order?

Contact support as early as possible with your order number. The available steps depend on whether the order is unprocessed, being prepared or already dispatched. Read the Shipping Policy's cancellation guidance and Section 11; statutory rights remain unaffected.

Which payment methods are available?

The methods actually offered at checkout are the available options for that order. They may vary by order or destination. Do not rely on a payment logo elsewhere as confirmation; contact support if the checkout does not make your options clear.

Is Cash on Delivery available?

The Shipping Policy offers COD for eligible orders and serviceable destinations. It is available for your purchase only if it appears at checkout. COD orders may be confirmed before dispatch. See Cash on Delivery for more information.

What happens if a product is unavailable?

If a product in your order cannot be supplied, the issue and available resolution must be communicated. A substitution requires your agreement, and any amount due back for unfulfilled goods must be refunded under applicable law. You do not have to accept a different product automatically.

Where can I read the Shipping Policy?

Read the KASHMIRCART Shipping Policy for serviceability, charges, delivery estimates, tracking, COD and delivery issues, alongside the information provided for your order.

Where can I read the Return and Refund Policy?

The existing document is the Refund and Returns Policy. Read it with Section 11 of these terms. Policy conditions cannot remove mandatory legal remedies, including for defective or misdescribed products.

How can I report a damaged or incorrect order?

Email yourordertkc@gmail.com or contact support on WhatsApp with your order number, a description and any available photographs or video. Keep packaging where reasonably possible. Contact us even if no unboxing video is available; its absence does not, by itself, defeat a statutory claim.

How can I contact KASHMIRCART?

Email yourordertkc@gmail.com, call +91-7006154418 or use WhatsApp. The Contact page has the published support details. Never share passwords, OTPs, CVV or full card details.
